Hadrovic was found guilty of assaulting civilian Sekula Poletan. Hadrovic punched Poletan in the head and hit him with a rifle butt, while cursing him, during a collection of illegal weapons in the village of Plandiste in the municipality of Kakanj in 1993. According to the verdict, Fadil Dajic then killed Poletan.
Presiding judge Nermin Tesnjak said the trial chamber was of the opinion that the testimony of prosecution witnesses was “trustworthy and convincing,” even after the examination of an additional defense witness at the retrial.
“The chamber has not brought into suspicion the witness testimony in terms of the decisive facts. We consider it was aimed at making the defendant’s position easier,” Tesnjak said.
According to Tesnjak, the allegations of prosecution witnesses were also confirmed by the findings of a medical expert, who deemed that the injuries on the injured party’s head were caused by a hard object and were life-threatening.
In 2014, Hadrovic was sentenced to ten years in prison. The Supreme Court of the Federation of Bosnia and Herzegovina repealed the verdict and ordered a retrial.
The parties have the right to appeal against the verdict with the Supreme Court of the Federation of Bosnia and Herzegovina.
