Andabak, a former member of the Croatian Defense Council, has been charged with commanding an operation in the village of Grborezi in the municipality of Livno on July 21, 1993. Members of the military police of the Second Light Assault Battalion of the Croatian Defense Council killed one person and wounded another by opening fire at them, in Andabak’s presence.
Members of the Second Light Assault Battalion then allegedly wounded another person, whom Andabak killed by firing a bullet in his head.
At today’s hearing, prosecutor Lejla Konjic said Andabak’s criminal record indicated that the defendant was found guilty of falsifying his personal identification. The defense requested that Andabak’s criminal record be separated from the rest of the material evidence, and objected to its lawfulness and relevance to the case.
Several reports indicating that protected witnesses for the prosecution recognized Andabak were also included in the case file. Death certificates for a certain number of victims, photo documentation and a sketch of the crime scene were also included.
The prosecution also presented the organizational scheme of the Croatian Defense Council’s military police, which depicted its course of establishment and chain of command. According to this document, Zdenko Andabak was the assistant chief of the Military Police Directorate.
The defense objected to the authenticity, lawfulness and relevance of a series of documents presented by the prosecution at today’s hearing.
The prosecution intended to present reports on Zdenko Andabak’s examination from when he was a suspect in the case, and not yet formally indicted. The trial chamber said Andabak would testify in his own defense instead.
The next hearing will be held on December 2, when the defense will begin presenting its evidence.
