Prosecutor Munib Halilovic requested the Court to sentence Svetomir Ilic, Milorad Cvijanovic, son of Milan, Vaso Ilic and Milorad Cvijanovic, son of Nenad, to longer imprisonment sentences.
In March 2014 the Cantonal Court in Tuzla sentenced Svetomir Ilic to six, Cvijanovic, son of Milan, and Vaso Ilic to five years each and Cvijanovic, son of Nenad, to two-and-a-half years in prison. All four of them were sentenced, under the first instance verdict, for having committed crimes against members of the Territorial Defence in Srebrenik and Tinja as members of the Republika Srpska Army, VRS.
The verdict says that the crimes were committed against Nadil Poljakovic, Avdo Hodzic, Hazim Zukic and Edin Malkic, who were beaten up and tortured in various ways, in June and July 1992.
Miodrag Stojanovic, Defence attorney of the four indictees, requested the Court to quash the Tuzla Cantonal Court’s verdict, claiming that it was “contradictory to itself and incomprehensible.”
According to Stojanovic, in that verdict the Cantonal Court said that the crimes caused consequences to injured parties’ health. Only one court expert, who spoke about Poljakovic’s mental condition, was examined.
Stojanovic proposed to the Court to quash the verdict and order a new trial before the Supreme Court or acquit the indictees or reduce their sentences.
Indictee Milorad Cvijanovic, son of Nenad, said that he was in the other part of Smoluca in the period, when the crimes were committed.
The Supreme Court will render its decision at a later stage.
