The Cantonal Court in Bihac sentenced Dautovic, in May last year, because, acting in collaboration with a few other members of the National Defence of the Western Bosnia Autonomous Region, ND WBAR, he took 12 civilians from Drmaljevo detention camp to the dispensary in Velika Kladusa, where they brutally physically abused them, on June 18, 1994.
In August 1994 Dautovic participated in the taking of 15 detainees from Drmaljevo. Rasim Erdic, who died due to being abused, was among the detainees. According to the verdict, he was leader of an interventions group for guarding building and persons with the Ministry of Defence and military police of the ND WBAR.
Both the Bihac Cantonal Prosecution and the Defence of the indictee appealed the verdict. They filed their appeals due to violations of the criminal proceedings, violations of the Criminal Code, wrongly and incompletely determined factual status and duration of sentence.
The Supreme Court of FBiH partially upheld the Defence’s appeal, revoked the first instance verdict and ordered a retrial.
