Appellate Chamber Chairwoman Azra Miletic said that material evidence and determined facts would be taken over from the first instance trial, but statements given by 19 witnesses would be heard again.

“This Chamber has decided to hear the statements by those witnesses, who spoke about the indictees’ presence in the Crisis Committee, their importance and position, as well as direct participation in the crime,” Miletic said.

As she explained, the Appellate Chamber would first hear the indictees’ statements, which they gave while testifying in their defence at the first instance trial.

Adamovic and Lukic are charged with having participated in the preparation, organization and execution of a widespread and systematic attack against the non-Serb civilian population in Kljuc municipality from April to December 1992.

Indictee Lukic was Commander of the Territorial Defence Headquarters of Kljuc municipality and member of the Municipal Crisis Committee, while Marko Adamovic was member of the Crisis Committee of Kljuc municipality and Commander of the Town Defence Command.

Under the first instance verdict, indictee Adamovic and Lukic were acquitted of charges but the Appellate Chamber revoked the verdict and ordered a retrial.
