The District Court in East Sarajevo on Monday found ex-soldier Andjelko Pusonja not guilty, saying that the prosecution had not managed to prove that the defendant killed a child and injured an adult civilian in the village of Bogaz in the Han Pijesak municipality in 1992.

According to the charges, in early morning of August 15, 1992, Pusonja went to a family’s house in the village of Bogaz, broke down the house door and opened fire with an automatic rifle, the indictment claimed.

While the parents were trying to escape from the house through the window, carrying their two-year-old daughter in their arms, Pusonja shot the child in the chest, the indictment claimed.

The child died of her injuries, and one of her parents was badly injured in the shoulder, stomach and leg, it added.

But the court said that the prosecution did not provide enough evidence, and also did not prove that there was an armed conflict between the Bosnian Serb Army and the Bosniak-led Bosnian Army in the area at the time when the child was shot dead.

The verdict can be appealed.
