Branko Mitrovic, Prosecutor with the District Prosecution in Banja Luka, presented, as material evidence, a proclamation by the Serb People’s Assembly on the immediate danger of war, which was published in the Serb people’s official gazette in 1992.

In addition, the Prosecutor presented a decision on the proclamation of the state of war, rendered by Alija Izetbegovic, Chairman of the Presidency of Bosnia and Herzegovina, in 1992.

Nebojsa Balaban, Defence attorney for indictee Todorovic, objected to these pieces of material evidence because, he said, “legal acts cannot be used as evidence”.

The Trial Chamber of the District Court in Banja Luka admitted the evidence and included it in the case file.

Milan Todorovic is charged with attempting to kill Muhamed Zulkic on May 30, 1995.

The indictment alleges that Todorovic waited for Zulkic next to a summer house in Celinac, and threw a grenade at him. It further alleges that Zulkic suffered severe stomach injuries and head contusions. He was saved after undergoing surgery directly following the incident, the Prosecution argues.

Todorovic is defending himself while at liberty.

The trial is due to continue on May 10.
