State Prosecution Requests Repeal of Dzevad Dulic Acquittal

In September 2015, the state court acquitted Dzevad Dulic, a former member of the Bosnian Army (ABiH), of charges of raping a woman in the Cazin area in December 1993.

Addressing the state court’s appeals chamber, prosecutor Vedrana Mijovic asked the court to revoke the verdict of release against Dulic and to order a retrial.

Mijovic said that the factual status in the case was incorrectly and incompletely determined during the first instance trial and that substantial violations of the criminal proceedings provisions also occurred.

“The court neglected the fact that prior to being raped, S-1 sat at a table with defendant Dulic at Ferida Beganovic’s house and he forced her drink brandy and inquired about her husband,” Mijovic said.

Mijovic said that after the rape S-1 met the defendant twice. She said S-1 also identified him in photos during the investigation and the main trial.

Dulic’s defense called upon the appeals chamber to reject the prosecution’s appeal as unfounded and confirm the first instance verdict.

“The prosecution has not submitted any pieces of evidence indicating that the factual status was incorrectly and incompletely determined or that the provisions of the criminal proceedings were violated. For this reason, we believe there is no evidence which would bring the first instance verdict into question,” defense attorney Zumreta Akagic-Bavcic said.

The appeals chamber of the state court will render its decision at a later stage.
