Bosnian Serb Soldier Acquitted of Foca Killings

Fundup was found not guilty on Friday of taking part in the killings and abuse of Bosniak civilians in the Cohodor Mahala neighbourhood of Foca in mid-1992.

“The Bosnian prosecution failed to prove beyond all reasonable doubt that Fundup is the man who killed and abused the Bosniaks in Foca, so the trial chamber was forced to acquit him of all charges,” said presiding judge Halil Lagumdzija.

According to the judge, the testimony of a key protected witness codenamed C1 was contradictory and illogical.

Lagumdzija explained that C1 heard in hospital that Fundup was the man who killed two children and five adult Bosniak civilians in a house in Cohodor Mahala but could not recognise him in the courtroom.

“The witness testimonies have seriously brought into question all the charges of the prosecution,” said Lagumdzija.

Fundup was also acquitted of abusing civilians in Gornje Polje in Foca by lining them up near a building and pointing a rifle at them thereby giving them the impression that he would kill them.

Lagumdzija said that prosecution witness Sadika Bico could not clearly identify the defendant as the perpetrator and her claims are not in line with the statements of her children.

Fundup was freed of the obligation to pay the court’s.

The verdict can be appealed.
