Presenting its closing statement, the Prosecution requested the Court to pronounce Majstorovic guilty and sentence him in accordance with the law, while the Defence called for a verdict of release.

The indictment alleges that Majstorovic, a former crime inspector, treated civilian Senad Trbo in an inhumane manner and intentionally caused bodily pain and mental suffering of that civilian in the Kula Facility in May 1992.

Prosecutor Tarik Crnkic said, in his closing statement, that it had been proved that the crime was committed during the war and that the indictee’s function in the Kula Facility, the fact that Senad Turbo was a civilian and that Majstorovic treated him in an inhumane manner causing severe suffering and pain of that person, had also been proved.

He pointed out that Senad Turbo authentically said what Luka Majstorovic did to him and that he identified the indictee in the courtroom.

“He said that the examination happened in the Administration building within the Facility complex and that he caused him severe pain by hitting him with his legs,” Crnkic said.

According to him, the indictee was the only crime inspector in Kula, who wore military uniform.

Defence attorney Borislav Jamina said that the Prosecution had not proved that Majstorovic examined and beat Senad Turbo.

“Witness Turbo was mistaken in identifying the indictee. It was obviously a military chieftain,” Jamina said, mentioning that Turbo confirmed that the person, who beat him, told him several times: “You opened fire at my soldiers”.

The Defence attorney said that Turbo said that the indictee was dressed in camouflage uniform and a bullet-proof vest, while Defence witnesses and the indictee himself confirmed that he used to wear civil suit or uniform of the former Yugoslav National Army, JNA.

“Defence witnesses confirmed that the indictee did not wear camouflage uniform in May 1992,” Jamina said, adding that the indictee was a police servant.
