In its motion the Prosecution said that the indictee had a strong motive to flee and that he possessed the citizenship of Croatia.

Prosecutor Milanko Kajganic explained that the indictee had lived in Slavonski Brod, Croatia, for 22 years and that he owned an undertaking business, adding that he had a devastated house in Bosanski Brod, which was not suitable for living.

The Prosecutor mentioned a danger that he might influence witnesses as the second reason for requesting the extension of custody.

“During the examination the indictee said that he knew the injured witnesses. (…) He has a strong motive and interest to influence injured party N.H.,” said Kajganic.

Condric, a former member of the military police with the Croatian Defence Council, HVO, is charged with having raped a female person, who was detained at the “Polet” football stadium in Bosanski Brod in 1992, and participated in the mental and physical abuse of civilians.

The Defence pointed out that there was not a single piece of evidence that would justify the extension of custody, proposing to the Court to order prohibiting measures instead.  

“Injured party N.H. has never mentioned my client’s name. (…) She did mention the name Mato, but not the last name,” attorney Davor Silic said.  

He said that, in her statement given last month the witness mentioned the last name Condric, but she did it only after having been shown a photograph from 1989.

“The identification was unlawful,” Silic considers.

The Defence thinks that the fact that the indictee had citizenship of Croatia, or, in fact, dual citizenship, could not be considered the basis for ordering him into custody, but the basis for other measures.

The Defence said that indictee’s friends offered their property as a guarantee in turn for Condric’s release from custody. The Prosecution objected to this proposal, because no documents or data about the value of the real estate had been filed.

On December 8 the Court of BiH confirmed the indictment against Condric, who was arrested on November 12.
