“The conditions for holding the hearing have not been met,” preliminary hearing judge Zeljka Marenic said, adding that the indictee was in Serbia, whose citizenship he had, and that he had received the invitation for this hearing.

State Prosecutor Vesna Ilic reminded the parties that, back in 2010, when the case was still in the investigation phase, the Court of BiH issued an international arrest warrant against Popic.

“The Court needs not issue another warrant, as the original one is still in effect,” Marenic concluded.

Popic, former Commander of the Police Station with the Public Safety Station in Gacko, is charged with having participated in persecution of the Bosniak population from Gacko municipality from April to the end of 1992.

The Prosecution of BiH charges him with having been a member of a joint criminal enterprise based on a discriminatory intention and planned, ordered, committed, abetted and assisted in the persecution of the Bosniak population.

The indictee is charged with detention, murders, torture, deportation and enforced relocation of the population.

The Court of BiH confirmed the indictment against Vitomir Popic in January 2013.
