Presenting its closing statement, the Defence of Adamovic said that the indictee was not member of a joint criminal enterprise and that the Prosecution had not proved the allegations contained in the indictment.

“Marko Adamovic is not a criminal, who committed the crimes charged upon him, so we propose to the Court to acquit him of all counts contained in the indictment,” said Branko Gudalo, Defence attorney of the indictee.

The indictee himself addressed the Chamber, saying that he was not the kind of person the Prosecution said he was.

“I am sorry for everything that happened to my neighbours, but I was not able to prevent that. Who am I? I was an ordinary military servant,” Adamovic said.

Adamovic and Bosko Lukic are charged with having participated in the preparation, organisation and execution of a widespread systematic attack against non-Serb civilians in Kljuc municipality from April to December 1992.

The Prosecution alleges that Lukic was Commander of the Territorial Defence Headquarters and Adamovic Deputy Commander of the Kljuc Battalion of the Territorial Defence and Commander of the Town Defence Command.

Under a first instance verdict, the Court of Bosnia and Herzegovina acquitted Lukic and Adamovic of charges. The Appellate Chamber quashed the verdict and ordered a retrial.

The Defence said that Adamovic did not have a managerial role and that he was always an auxiliary.

“Adamovic was always an auxiliary, assistant, deputy…You will not find any documents, which he signed as a chief,” Gudalo said.

Also, he said that the indictee did not command the Kljuc Battalion, because the Battalion had constantly had its own commander.

Gudalo said that the Prosecution’s indictment was unclear and that it did not explain the indictee’s alleged discriminatory intentions.

Presenting its closing statement, the Defence of Bosko Lukic called on the Court to acquit the indictee, while the Prosecution requested it to sentence Lukic and Adamovic to long-term imprisonment.
