“We tried to reach the witnesses, but we have not succeeded. We therefore propose that their previously given statements be read in the courtroom,” Nedim Dobojlic, Defence attorney of indictee Curtic, explained.

The Trial Chamber established that the statements given by witnesses at a previous trial were read at this hearing and material evidence presented.

The Cantonal Prosecution in Sarajevo charges Curtic, who allegedly acted as a guide to a part of the “Maturice” Unit with the Croatian Defence Council, HVO, with having hit and robbed civilians following an attack on Stupni Do village on October 23, 1993.

On October 31, 2011 the Cantonal Court in Sarajevo sentenced Curtic to five-and-a-half years in prison. The Supreme Court of the Federation of Bosnia and Herzegovina, FBiH, quashed the verdict in May 2012 and ordered a retrial. In December last year the retrial began before the Cantonal Court in Sarajevo.

The Prosecution announced that it would rearrange the indictment, as proposed under the decision by the Supreme Court of FBiH, by the next hearing.

The trial formally began anew, because more than 30 days, which is a legal deadline for renewing a trial, had passed since the last hearing.

The trial is due to continue on November 4.
