Proving the Status of Two Indictees

The Prosecution of Bosnia and Herzegovina presented a document it said proved that indictees Najdan Mladjenovic and Savo Zivkovic were members of the Territorial Defence, TO.
Prosecutor Ozrenka Neskovic introduced 32 pieces of material evidence, including a list of TO members from May 1992 that contained the names of the two indictees.
Neskovic also presented extracts from the indictees’ military records, as well as other documents with which she wanted to prove “the indictees’ status in the period covered by the indictment”. The Defence teams objected to the relevance of the pieces of evidence.
“I do not know what the Prosecution means by saying that it wants to prove Mladjenovic’s status. This document does not mention that he is a commander of the TO, but it just contains general data. I do not know what status the Prosecution wants to prove, so I object to the alleged relevance of this document,” said Dejan Bogdanovic, defence attorney for Mladjenovic.
Mladjenovic and Zivkovic are charged with having unlawfully arrested and abused Bosniak civilians as part of a widespread and systematic attack on Hranca and Glogova villages, Bratunac municipality, on May 3 and 9, 1992.
According to the charges, Mladjenovic was Commander of the Territorial Defence in Bratunac, while Zivkovic was a member of the unit at that time.
Prosecutor Neskovic then introduced a series of documents in order to prove the existence of a widespread and systematic attack and the establishment of the Serbian Democratic Party and party leadership and governance bodies.
The documents included an order for general mobilization issued by the Crisis Committee of the Serbian municipality of Bratunac on April 16, 1992, as well as an order for the confiscation of weapons from non-Serb citizens in the Bratunac area.
The Defence objected to all pieces of material evidence presented by the State Prosecution, claiming that they were irrelevant.
The trial is due to continue on May 21, when a court medical expert will be examined.
