Dusko Ninkovic, the judge at the preliminary hearing, said the court didn’t receive a receipt which confirmed that the summons for this hearing had been delivered to the defendant.

“The same situation arose at the last hearing. The Ministry of Justice of Bosnia and Herzegovina and the High Judicial and Prosecutorial Council have been informed about this problem. The only thing we can do in this situation is schedule a new hearing and urge the Bosnian Ministry of Justice and request that the competent authorities in Croatia deliver the summons to the defendant,” Ninkovic said.

Jazvic, a former member of military police with the Croatian Defense Council, has been charged with the unlawful arrest of Serb men, primarily the elderly and those incapable of military service, in the village of Mala Brusnica in the municipality of Bosanski Brod in late June 1992. After the arrest, Jazvic allegedly took the captives to the Tulek detention camp, located in the storage area of the Beograd department store in Bosanski Brod, where they were subjected to abuse.

A new hearing in this case will be held on October 23.
