Extension of Custody for Icanovic Proposed

The Defence proposed that custody be replaced with prohibiting measures. Following the presentation of data about indictee’s difficult health condition, the Prosecution agreed that Icanovic be ordered into home detention.  

Prosecutor Vedrana Mijovic requested an extension of custody due to a danger of flight, adding that the indictee had the citizenship of both Bosnia and Herzegovina and Croatia, that he had a close relative in Croatia and that his parents lived in Germany.
 
The State Prosecution charges Icanovic, former Commander of the 505th Brigade with the Fifth Corps of the Army of Bosnia and Herzegovina, ABiH, with having killed and abused prisoners of war in the Velika Kladusa area.  

The indictment alleges that, in late 1994 Icanovic killed two prisoners of war, members of the Western Bosnia Autonomous Region, and beat other prisoners with a rifle butt in Latica Glavica area, near Velika Kladusa.  

The Court of BiH confirmed the indictment on September 18.
 
Defence attorney Sulejman Kadic proposed that the Court replaced custody with prohibiting measures, pointing out that the indictee’s health condition was difficult and that he got a severe injury of his arm, so he needed physical therapy.
 
“I propose that he be banned from moving, that he be ordered to report to the police administration every day, that is travel documents be confiscated and that he be banned from contacting the witnesses,” Kadic said, but he pointed out that he also agreed with the proposal to order him into home detention.
 
The Court will render a decision at a later stage.
 
Icanovic was arrested in late August. He has been held in custody since.
