Gojko Pajic said that he was captured on May 8, 1992 and taken to the school gym in Odzak, adding that he was taken out and beaten several times. As he said, indictee Tolic was among the guards, who beat him.He once said something to Hamo. Hamo then approached me. They took me to a classroom and beat me up. Both of them beat me. They hit me on all parts of my body, he said, adding that Miro Kuresevic was taken out together with him on that occasion. Rifat Konjic, Defence attorney of the indictee, presented a statement given in 2009 in which the witness said that Hamo took him and Kuresevic out once and that some unknown soldiers then beat them, but he did not mention the indictee. The witness responded by saying that this was not the same event. Tolic, former member of the 102nd Odzak Brigade of the Croatian Defence Council, HVO, is charged with having participated in the abuse of Serb detainees in the Odzak and Bosanski Brod area from May to October 1992. When asked by the Defence attorney why he failed to describe the event involving Hamo and Tolic in his statement given in 2009, the witness said that it probably did not come to my mind, adding that he had not had a chance to describe most of the things he survived. In response to several questions by the Trial Chamber to try to clarify the event, when he and Kuresevic were taken out, the witness said that he stuck to his statement given in 2009. Pajic said that the indictee beat him several times during his detention in the school building in Odzakk. He told the Court that he was once taken out, along with five or six other detainees, and that Tolic beat him with his legs and hands. I do not even know how many times they took me out. I had to go out for my brother too several times. My brother was disabled. He had problems with his spine, so I did not want them to beat him. When they called us out according to our years of birth, I would come out instead of him, the witness said. He mentioned that an unknown person took him to a classroom, where he saw a naked woman on a desk. A naked woman was on a desk. He told me: Come on, do her, and youll get something to eat. I said I could not do it. He ripped my trousers. I was then taken back downstairs, he said. In July 1992 the witness was transferred from Odzak to a school building in Novi Grad. He said that he used to see Tolic in that building as well, adding that two or three days later he was transferred from the school to Bosanski Brod. He told the Court that, while he was there, he witnessed the beating of a group of detainees. He said that Tolic was among the persons, who beat those detainees. The trial is due to continue on June 13.
