Longer Sentence or New Trial

In October last year the Cantonal Court in Mostar sentenced Scuk to six years in prison for crimes against civilians in the Jablanica area. He was pronounced guilty of having killed Iva Pavlovic in Krkaca hamlet on July 28, 1993.
Federal Prosecutor Tihomir Jurko requested the Court to accept an appeal filed by the Cantonal Prosecution in Mostar and pronounce longer imprisonment sentence against Scuk.
“I propose that the appeal filed by the Defence attorney of the indictee be rejected as unfounded and that the Cantonal Prosecution’s appeal be accepted,” Jurko said.
The Defence filed an appeal due to the violation of the proceedings, wrongly and incompletely determined factual status, wrong application of the substantive law and decision on criminal and legal sanction.
“The Defence considers that the Court wrongly and incompletely determined certain facts, like the distance from which the bullet was fired and the indictee’s location,” Defence attorney Sanela Dautbegovic said.
The Supreme Court will render a decision concerning the appeals at a later stage.
