Verdict against Guso and Suljagic Confirmed

The Appellate Court of Brcko District confirms a verdict of release against Nusret Guso and Mirsad Suljagic, who were charged with crimes against prisoners of war in Brcko municipality.

The Appellate Court’s Chamber rejected an appeal filed by the Prosecution of Brcko District and confirmed the verdict passed down in July last year. Under the verdict, Guso and Suljagic, former members of the Army of Bosnia and Herzegovina, BiH, were acquitted of charges.

Guso and Suljagic, former members of the 108th Motorised Brigade of the Army of BiH, were acquitted of charges that they beat prisoner of war Branko Radenkovic, while examining him at the beginning of August 1993.

Explaining the first instance verdict of release, Nijazija Kalender, Chairman of the Trial Chamber with the Basic Court of Brcko District, said that the Prosecution had not proved the allegations contained in the indictment.

“Although several statements given by injured party Radenkovic mentioned other people, who could be identified easily, the Prosecution decided to cover only these two indictees, when preparing the indictment. Another controversy refers to the fact that the injured party said that one of the indictees extinguished cigarettes on his body, torturing him in that way, but the Prosecution did not include that in the indictment,” Kalender said.

Indictees Guso and Suljagic defended themselves while at liberty during the trial.
