Court Expert without Final Conclusion

Testifying at the trial of six former members of the Army of Bosnia and Herzegovina, ABiH, court expert Asim Dzambasovic says that he has not been able to determine for sure which unit was responsible for civilians and prisoners in Trusina village, near Konjic.

Court expert in military issues Dzambasovic said that Trusina, where murders of Croats were committed on April 16, 1993, was in the zone of responsibility of the 45th Brigade and the Fourth Corps of ABiH.
 
He said that members of the 45th Brigade, “Tigers”, “Zulfikar” Squad and soldiers from Vakuf participated in the attack on Trusina. The court expert was not able to determine “who was subordinate to whom” in the field, because, while performing his military expert analysis, he did not come across such documents.
 
“The dilemma is how it was defined at a lower level. I did not have evidence about it,” he said.
 
The court expert testified at the trial of Mensur Memic, Dzevad Salcin, Nedzad Hodzic, Nihad Bojadzic, Zulfikar Alispago, former members of “Zulfikar” Squad, and Senad Hakalovic, former member of the 45th Brigade.
 
Edina Residovic, Defence attorney of Bojadzic, presented the expert with a document issued on April 12, 1993, which indicated that the “Zulfikar” was transferred from the Main Command Headquarters, which was led by Sefer Halilovic, to the First Corps and that it became subordinate to those Corps.
 
Dzambasovic said that this document and some other documents presented to him by Residovic indicated that the “Zulfikar” Squad was indeed subordinate to the First Corps.
 
Prosecutor Vesna Budimir said that this did not relate to indictee Bojadzic, former Deputy Commander of “Zulfikar” Squad, adding that the Defence attorney was conducting “an investigation about responsibility of a man, who is not charged.”
 
“She cannot use this case to conduct the investigation,” she said.
 
Residovic responded by saying that, by doing this, she was defending Bojadzic from the indictment. The indictee said that the Defence attorneys defended him exclusively.  
 
According to the charges, the “Zulfikar” Squad, which was commanded by Alispago, was part of the Main Command Headquarters, when the Trusina crimes were committed.
 
Responding to Alispago’s questions, the court expert said that the Commander was obliged to “follow the situation” in his zone of responsibility.
 
At the last hearing held on October 14 Prosecutor Budimir did not want to ask Dzambasovic questions about command responsibility, as he was “a member of the Presidency of Sefer Halilovic’s party”.
 
During the hearing today Dzambasovic said that he had never been a member of that Party.
 
The trial is due to continue on November 4.
