Local Justice – Smajic: Verdict of Release Confirmed

Izet Smajic, former member of the reserve police forces, has been acquitted, under a second instance verdict, of the charges that he wounded a Yugoslav People's Army soldier in Tuzla in May 1992.

The Supreme Court of the Federation of Bosnia and Herzegovina did not accept the arguments contained in the appeal filed by the Tuzla Cantonal Prosecution. It confirmed the verdict of release.Smajic, former member of the Mosnik Independent Reserve Police Unit, was acquitted of the charges that he wounded Radovan Krstic during the withdrawal of a convoy of the Yugoslav People’s Army from the Husinska buna military barracks in Tuzla on May 15, 1992.On November 22, 2010, the Tuzla Cantonal Court acquitted Smajic of the charges, but the Tuzla Cantonal Prosecution filed an appeal due to “wrongly determined facts”.The Defence argued that the Cantonal Prosecution’s appeal should be rejected due to lack of evidence that Smajic committed the crime for which he was charged.
