State Prosecution Calls for Repeal of Popovic Acquittal

Prosecutor Seid Marusic said Popovic’s verdict of release should be appealed. He said a retrial should be held before the appeals chamber due to the incorrectly determined factual status of the case and the violation of criminal proceedings during the first instance trial.
“The first instance chamber didn’t assess the evidence to the extent to which it should have,” Marusic said.
On April 30, 2015, Popovic was acquitted of charges of deliberately participating in the persecution, abuse and torture of the non-Serb civilian population in the municipality of Visegrad as part of a widespread and systematic attack by the Bosnian Serb Army conducted in 1992 and 1993.
Defense attorney Milos Peric asked the court to reject the prosecution’s appeal as unfounded, saying there was no reason to revoke the verdict of release.
The appeals chamber of the Bosnian state court will render a decision at a later stage.
