Presiding judge Alphons Orie said that he would allow the appeal since the “trial would benefit from a timely decision on these issues”.
“The Chamber considers that a decision whether there is evidence capable of supporting a conviction of the Accused on the genocide counts is, due to the centrality of the genocide charges, an issue that would significantly affect the outcome of the trial”, said Orie.
Mladic’s Defence asked to appeal this decision, claiming the Trial chamber did not provide justification for inferring genocidal intent.
Mladic, who is on trial for genocide in Srebrenica and seven other municipalities, persecution, terrorising Sarajevo residents and taking UN peacekeepers hostage, asked to be acquitted of all charges after the prosecutors finished presenting their evidence, but the Trial chamber rejected his request in April this year.
Mladic’s trial started in 2012, after he spent 16 years on the run.
Considering the request was rejected, Mladic’s lawyers will start presenting their evidence next week.
