Protected witness D, who was due to testify against Subotic, refused to appear at the trial – the Trial Chamber of the Court of Bosnia and Herzegovina announced.

Although Trial Chamber Chairman Zoran Bozic said that the witness might be apprehended forcibly, he allowed the possibility that the Prosecutor spoke to him first.

Prosecutor Slavica Terzic said that this was an important witness, adding that she would visit him and speak to him, because she “does not want to go for the apprehension option first”.

Also, it was said that, by the next hearing the Prosecution and Defence would agree concerning the undisputable pieces of material evidence, which would be included in the case file.

Vehid Subotic, former member of the Army of Bosnia and Herzegovina, ABiH, is charged with crimes against Croat civilians in Dusina village, Zenica municipality, in 1993.

The trial is due to continue on December 4.
