The first instance Chamber established that the Prosecution of Bosnia and Herzegovina had not proved that Neskovic and Ilic, former member of Jahorina Training Centre with the Special Brigade of Republika Srpska police, participated in the capture of Bosniaks, whom they took to the Agricultural Co-operative in Kravica, near Bratunac, where about 1,000 of them were killed.

Also, the Prosecution has not proved that Ilic shot at the men, who had already been killed, from an automatic gun, while two Centre members killed two of the captives, as per Neskovic’s order.

In September 2013 the Prosecution of Bosnia and Herzegovina requested the revocation of the verdict of release against Dragan Neskovic and Zoran Ilic, asking the Court to renew the trial as per the indictment for crimes against humanity committed in Srebrenica in July 1995.

The Defence of Neskovic and Ilic requested that the State Prosecution’s appeal be rejected and verdict of release be confirmed.

After having considered the appeal, the Court of Bosnia and Herzegovina confirmed the verdict of release against Neskovic and Ilic.

The parties do not have the right to appeal this verdict.
