Expert witness Emira Ejubovic presented her findings following a Prosecution’s proposal to allow the injured party not to be present in the courtroom during her testimony. The Trial Chamber will render a decision concerning the proposal once an additional expert examination has been conducted.

Ejubovic said that the injured party would not be able to stand facing the indictee.

“Considering all of the facts related to the crime and the injured party’s current emotional state, I think that it would be absolutely justified to grant special protection measures to her, as a vulnerable witness, and ensure the conditions that would prevent her from meeting the indictee at this trial,” Ejubovic said.

The indictment alleges that Kadic, former member of the Army of the Republic of Bosnia and Herzegovina, is charged with having forced Marta Vanovac to have sexual intercourse with him twice on June 27, 1992.

The Defence objected to the expert’s findings, explaining that it was solely based on a conversation conducted in the Police Station premises in Zvornik.

The Defence requested that all medical documents pertaining to the injured party be reviewed.

The Trial Chamber upheld the objection, ordering the Prosecution to obtain the documentation prior to the next hearing.

“The expert witness will review the medical documentation pertaining to Marta Vanovac on that day. We shall then continue examining the expert witness and make a decision concerning the injured party’s status,” said Trial Chamber Chairman Enes Malicbegovic.

The trial is due to continue on May 7.
