Prior to the beginning of the retrial Defence attorney Vasvija Vidovic requested the Appellate Chamber of the Court of Bosnia and Herzegovina not to admit new pieces of the Prosecution’s evidence, namely the examination of Osman Sego and the presentation of medical expert witness’ findings related to the murder of Vlatko Kapetanovic.

Vidovic said that she objected to the examination of the expert witness, because the State Prosecution could have examined him during the first instance trial.

At a status conference held prior to the beginning of the retrial Prosecutor Slavica Terzic said that Sego could not have been examined earlier, because he was suspected of crimes committed in Bugojno and defended himself with silence.

After having admitted guilt in June 2011, Sego, former member of Military Police with the 307th Brigade of the Army of Bosnia and Herzegovina , ABiH, was sentenced to five years in prison for crimes in Bugojno and participation in the murder of Vlatko Kapetanovic.

Osmic, former military policeman with the 307th Brigade of ABiH, was pronounced guilty, under a first instance verdict, of having abused captured Croats and participated in the murder of Vlatko Kapetanovic. As previously announced by the Court of Bosnia and Herzegovina, the Appellate Chamber revoked the verdict due to “the overstepping of the indictment and its incomprehensibility”.

At the beginning of the retrial the Court heard statements by two State Prosecution witnesses Ivan Kapetanovic and Ivica Keskic. As said earlier, a total of six witnesses’ statements will be heard.

The retrial is due to continue on May 23.
