At a pre-trial status conference in the case of Milun Kornjaca, Milorad Zivkovic and Dusko Tadic, the Trial Chamber said it was not able to fulfill a court medical expert’s request that the first indictee undergo a coronarography because Kornjaca refused to have the screening at the Kosevo Hospital in Sarajevo.

“We contacted the Kasindol Hospital in Eastern Sarajevo. They said they were not equipped to perform a coronarography. We then proposed to the indictee to undergo the test at the Kosevo Hospital, but he refused to undergo any medical treatment in the Federation of Bosnia and Herzegovina,” Trial Chamber Chairman Darko Samardzic said.

Kornjaca said the examinations had to be done on the territory of Republika Srpska, because he “does not feel safe in Sarajevo”.

At the last hearing, held on September 13 this year, physicians Marija Kaucic-Komsic and Radojka Golijan presented their findings and opinion about Kornjaca’s health condition. They determined that “the detainee is temporarily unable to follow the trial until additional diagnostic examinations have been conducted”.

Kornjaca, Zivkovic and Tadic are charged with having participated in a broad and systematic attack against the non-Serb population in Cajnice municipality and the detention, torture, murder and forcible resettlement of civilians from that area from April to the end of May 1992.

The indictment alleges that Kornjaca was Commander of the “Blue Eagles” paramilitary unit, Tadic was a member of the Unit and Zivkovic was Chief of the Public Safety Station in Cajnice and member of the Crisis Committee in that town.

The Prosecution charges them with having participated, by shooting from automatic rifles and throwing hand grenades, in the murder of 11 civilians who were detained in a hunter’s hut in Mostina in May 1992.

The indictees have been held in custody since December 2009. The indictment against them was confirmed in June this year.

When asked by the Trial Chamber Chairman how he was feeling, indictee Kornjaca said he wanted to attend the trial, but he was not capable of doing so due to health problems.

The Trial Chamber decided to hold another status conference on October 11, when another expert assessment of the first indictee’s health condition will be performed.
