The Bosnian state prosecution has called upon the federal supreme court to confirm Dalibor Milos’ acquittal and to order a retrial for Miroslav Skoro.
Skoro, Milos, Bosiljko Dilber and Ljubomir Dilber, former members of the Croatian Defense Council, were charged with war crimes against prisoners of war in the village of Behrici, near Kiseljak. The injured parties in the case, Ramo Hatidzic, Memsudin Planincic and Vahid Klisura, were captured and tortured. Klisura was eventually killed.
On January 21, 2015 the cantonal court of Novi Travnik acquitted Miroslav Skoro and Dalibor Milos of charges for war crimes against prisoners of war in the Kiseljak area in the summer of 1993.
Although the cantonal prosecution of Travnik proposed that the verdict be repealed for both defendants due to incorrect and incompletely determined facts, the state prosecution decided to uphold Milos’ acquittal.
As far as Skoro is concerned, the state prosecution called for a new trial before the first instance chamber.
Branka Praljak, Skoro and Milos’s defense attorney, proposed that the verdict of release be confirmed, maintaining that the guilt of the defendants hadn’t been adequately proven.
Praljak commented on the testimony by injured party Planincic. She said Planincic wasn’t clear when he identified Skoro as the person who shot at him. She said his testimony had been brought into question by the evidence presented by the defense.
The court will render a decision concerning the appeal at a later stage.
