The Defence said that it considered that the mentioned measure “existed unlawfully”, considering the fact that the Prosecution filed the indictment, but it failed to propose an extension of home detention or an explanation of what it was based upon.
In case the Court rejects its proposal for the termination of home detention, the Defence requested that it ordered less strict measures by enabling the indictee to leave his place of residence five times a week.
“The indictee lives with his sick, immobile mother. He is the only one who can go buy supplies and medication,” Defence attorney Sanja Bjelica said.
The Prosecution objected to termination of home detention, because it considered that there was a fear that he might flee and a possibility that he might influence witnesses and accomplices. It pointed out that all witnesses had requested protection measures.
The Prosecution of Bosnia and Herzegovina, BiH, charges Gojkovic, a former member of the Republika Srpska Army, VRS, with having raped a Bosniak female in Grbavica neighbourhood, Sarajevo, in September 1992.
The Court confirmed the indictment on January 6 this year.
Gojkovic was arrested at the beginning of December. Following his arrest, the Court of BiH ordered him into home detention.
