Verdict against Djogatovic on January 19

The Cantonal Court in Novi Travnik schedules the pronouncement of a verdict against Ilija Djogatovic, former member of the Republika Srpska Army, VRS, who is charged with crimes in Donji Vakuf, for Monday, January 19.

Prosecutor Ahmed Mesic said, in his closing statement, that it had been proved that Djogatovic committed war crimes, requesting the Court to pronounce him guilty.

“Following the four-month trial, examination of six witnesses, one court expert and two additional witnesses, the Cantonal Prosecution is convinced that indictee Ilija Djogatovic committed the crime against Sulejman Sutkovic, which is charged upon him,” Mesic said.

Defence attorney Branka Praljak said that Djogatovic did not shoot at Sutkovic and that the statement given by Prosecution witness Bakir Mustafica was incorrect.

“The killed people set off after 10 p.m. They did not know where they were going. They came across a division line between the two belligerent parties. They were not under protection according to the International Conventions called upon by the Prosecutor,” Praljak said.

She said that Djogatovic and Cedo Fonjga were wrongly identified in this case.

Djogatovic, former member of VRS, who was allegedly accompanied by Cedo Fonjga, who died in the meantime, is charged with having shot Sulejman Sutkovic and another civilian from the back in Cehajici village, Donji Vakuf municipality, in mid June 1992.

Prior to the presentation of closing statements, additional Prosecution witness Dzevad Doslic was examined. He said that he knew Cedo Fonjga and that he saw him in Donji Vakuf during the war after having been detained, along with about twenty of his fellow citizens.

Some Defence witnesses said before that Fonjga was in Austria during the entire war.

“I know Cedo Fonjga well, because we used to work together. While I was in prison, I saw him twice. He was uniformed. He walked towards a cafe along a narrow street,” Doslic said.
