The Bosnian State court has suspending the prison sentence of Djukic.

The Constitutional Court of BIH, in its session on 23 January 2014, upheld the appeal of the defendant Novak Djukic convicted before the Court of Bosnia and Herzegovina, finding that in his case the more lenient former Yugoslav Criminal code should have been used instead of the Criminal Code of Bosnia and Herzegovina.

Djukic, former Commander of the Ozren Tactical Group with the Republika Srpska Army, was found guilty of having ordered an artillery squad to shell Tuzla town from cannons on May 25, 1995.

Several artillery projectiles hit the downtown area, known as Kapija, killing 71 people.

The Constitutional Court has already accepted appeals filed by 13 other war-crimes convicts due to the wrong application of law.

Bosnian Army Ex-Soldiers Jailed for Beating Prisoners
Former Bosnian Army soldiers Muhko and Safet Velagic were found guilty of committing war crimes against prisoners of war in the Bugojno area in July 1993. The Cantonal Court in Novi Travnik sentenced Muhko Velagic was sentenced to seven years in prison and Safet Velagic to six years for war crimes against prisoners of war.
