Prosecutor Seid Marusic called on the Appellate Chamber to quash the verdict and order a retrial.
I consider that the decisive facts were determined wrongly. The event began with the arrest, in which Grujic participated. Also, he participated in the tying of the captives and escorting them to Bajkovica. An unknown soldier shot at them. He was not prevented from doing it, Marusic said.
The Prosecutor said that, under the first instance verdict, the event was classified as a third partys excess.
The indictment charges Grujic, former member of the Baljkovica of the Republika Srpska Army, VRS, who was allegedly accompanied by a few others, with having killed ten Bosniak civilians by shooting them from fire arms, in the Zvornik area.
Defence attorney Dragan Gotovac said that no significant arguments were contained in the appeal, adding that it was not true that the facts were determined wrongly.
The Court will render its decision at a later stage.
