Trial Chamber Chairman Darko Samardzic said that Zivkovic informed the Court that he would not testify in defence of indictee Kornjaca.
“He informed us that he had had a quarrel with Milun Kornjaca and that the indictee had not even informed him about the testimony. Also, he said that he would use his legal right not to testify,” judge Samardzic said.
Zivkovic is not obliged to testify, because a proceeding was conducted against him in another case, covering war crimes in Cajnice. In April this year he was sentenced under a first instance verdict to six years in prison for having issued orders and personally participated in the arrest of Bosniak civilians in 1992 in his capacity as Chief of the Public Safety Station in Cajnice.
The Prosecution of Bosnia and Herzegovina charges Kornjaca with having participated in the murder of 28 detained civilians, who were held in the hunters’ house at Mostina, after a member of the “Plavi orlovi” (“Blue Eagles”) paramilitary unit was killed in May 1992.
The former Commander of “Plavi orlovi” paramilitary units is on trial for persecuting Bosniaks from the Cajnice area.
The trial is due to continue on July 3, when a new Defence witness will be examined.
