Kovacevic et al: Prohibiting Measures Ordered

The Court of Bosnia and Herzegovina ordered prohibiting measures against four people, who are suspected of crimes in the Bihac and Cazin areas in March 1995. The prohibiting measures will last for one month.

The Prosecution of Bosnia and Herzegovina requested the Court to prohibit Muhamed Anadolac, Abid Ljubijankic, Sabahudin Hafuric and Husein Begic, former members of the Fifth Corps with the Army of Bosnia and Herzegovina, who were arrested on February 12, from leaving their places of residence and meeting accomplices and witnesses.

“The suspects might have a motive to meet their former comrades, as well as witnesses, who have spoken about the incriminated event,” Prosecutor Dragan Corlija explained.

He said that he decided to request prohibiting measures instead of custody, because there were no indications that the suspects might seek to flee.

The Defence of Anadolac, Ljubijankic and Hafuric objected to the prohibiting measures, while the Defence of Husein Begic agreed with the measures against its client.

Kerim Celik, Defence attorney of Anadolac, said that the suspect’s right to work would be violated by prohibiting him from leaving his place of residence, because he often had to travel to other towns in Bosnia and Herzegovina.

Fahrija Karkin, Defence attorney of Ljubijankic, objected to the prohibiting measures, because he considered that the general conditions for a grounded suspicion in the case of his client had not been proved.

“The Prosecutor has presented all pieces of evidence to me. Also, he has shown me a recording depicting the event, but it does not show my client’s participation in it,” Karkin explained.

Safet Kovacevic, former member of military police with the Fifth Corps, was arrested as part of the same investigation in October 2012. He is suspected of war crimes against Serb civilians and prisoners in the Bihac and Cazin area as well.
