The Prosecution of Bosnia and Herzegovina included, as evidence, the transcript of a statement given by protected witness PW-100 before the Hague Tribunal. However, the Defence wants to cross-examine the witness. According to the rules, the protected witness can be examined only in case he agrees to have his identity revealed to the parties to the proceedings, i.e. the Prosecution, Defence and Trial Chamber.
The witness does not want his identity to be revealed, Bulic said, adding that this witness refused to have his identity revealed at another trial before the State Court.
Kerim Celik, Defence attorney of the indictee, said that he would give up the examination of protected witness PW-100 if the Prosecution of Bosnia and Herzegovina withdrew the transcript of his testimony. Bulic did not agree to do that, so the Trial Chamber conditioned him to enable the cross-examination or else the transcript from the Hague would not be admitted as evidence.
The Prosecution of Bosnia and Herzegovina charges Kuvelja, former member of the Jahorina Training Centre with the Ministry of Internal Affairs of Republika Srpska, MUP of RS, with having participated in the shooting of more than 1,000 men in the Agricultural Co-operative in Kravica, near Bratunac in July 1995.
In case protected witness PW-100 is not examined on October 23, the Prosecution of Bosnia and Herzegovina will present its closing statement that day.
