Biljana Brkic, Defence attorney of Misic, said that the Court of Bosnia and Herzegovina, BiH, had not confirmed the indictment due to a lack of evidence.
The Public Relations Service of the Court of BiH says that they would announce the reason for rejecting the indictment “once we have received a response from legal advisors”.
Vidovic and Misic were arrested on December 24, 2013. After having examined them, the Prosecution of BiH filed a custody order motion against them. However, the Court of BiH rejected the motion, explaining that the evidence submitted by the Prosecution did not indicate that there was a grounded suspicion about the responsibility of Vidovic and Misic.
Six days later the Prosecution of BiH announced that it had issued an indictment and filed it with the Court of BiH.
According to the unconfirmed indictment, they participated, in their capacity as members of the Jahorina Training Centre with the Special Police Brigade of the Ministry of Internal Affairs of Republika Srpska, MUP of RS, in the shooting of ten Bosniaks, who had previously been captured, in Sandici village, near Bratunac, on July 13, 1995.
