“Unfortunately, I have just been informed that my client died,” said Fadil Abaz.
 
Judge Minka Kreho said that the proceedings against Aganovic would be separated from the proceedings against the six other suspects, adding that, once the Court had obtained the evidence, the proceedings against him would be discontinued.
 
At this hearing the Court considered a State Prosecution’s motion for ordering prohibiting measures against the six individuals, who are suspected of crimes in Rogatica. The Defence objected to the motion.
 
Prosecutor Mirza Hukeljic said that he requested the Court to order measures prohibiting the suspects from travelling, leaving their places of residence and meeting each other and witnesses.  

“The Prosecution has not come across any circumstances that point to existence of a danger of flight. (…) The measure, banning them from leaving their places of residence, is the most appropriate measure to ensure their presence at hearings,” Hukeljic said.
 
The Prosecution of Bosnia and Herzegovina suspects Muhamed Sisic, Izet Hadzic, Tarik Sisic, Emir Drakovac, Zahid Alic and Aziz Susa of having attacked Serb civilians, who were moving from Gorazde municipality towards Rogatica on August 28, 1992.  
 
The State Prosecution alleges that more than 20 victims, mainly Serb women, children and old persons, were killed in that attack.
 
The Defence attorneys of the suspects requested the Court to reject the Prosecution’s motion, claiming that it was unfounded. Muhidin Kapo, Defence attorney of suspect Muhamed Sisic, said that the investigation was opened back in 2006.  

“My client was examined several times. He responded to all invitations. He has nothing to do with the crime. There is no need to order any measures against him,” said Kapo.
 
The Defence attorneys of the other suspects presented similar arguments. The Court will render its decision at a later stage.
