Macic: Guilt Admission Agreement

As explained during the hearing held before the Court of Bosnia and Herzegovina, the guilt admission agreement included all of the counts contained in the indictment, except for the first one to which Miralem Macic pleaded guilty on September 8, 2011.
Under the mentioned count, Macic, former member of reserve forces with the Public Safety Station in Konjic, is charged with having taken one civilian out of a house in Bradina village, Konjic municipality in May 1992 and took the civilian, along with other Serb captives, to the highway, where he fired two bursts of bullets on his back, killing the captured civilian.
However, Trial Chamber Chairman Saban Maksumic said that the agreement could not be partial, but, according to the law, it had to pertain to all counts contained in the indictment.
Indictee Macic told the Trial Chamber that he wanted to withdraw the first count to which he pleaded guilty, but the Trial Chamber Chairman said that, according to the law, the agreement should contain all of the counts.
Prosecutor Sanja Jukic said that the Prosecution of Bosnia and Herzegovina would correct the first count, and make a new guilt admission agreement in collaboration with the indictee’s Defence.
It is an extreme success, when a person repents and admits guilt for crimes he committed. This man has been willing to cooperate from the first day, Defence attorney Dusko Tomic said.
Under the remaining counts, to which he originally pleaded not guilty, Macic is charged with having caused severe bodily pain and suffering to Serb civilians, while capturing them in Bradina village. He is further charged with having been present, along with other members of reserve forces of the Public Safety Station from Konjic, in Sitnik village, Konjic municipality in June 1992, when he killed an immobile old man.
Macic is charged with having physically abused a Serb and confiscated a vehicle in Varda village, Konjic municipality on September 18, 1992.
The next hearing, at which the revised guilt admission agreement will be considered, is due to be held on January 25, 2012. M.B.
