According to the International Criminal Tribunal for the Former Yugoslavia (ICTY) statement, Tupajic was ordered to testify before The Hague Tribunal on October 5, 2011, and November 8, 2011, respectively, but he did not comply with these orders.

After the warrant for his arrest was issued, Tupajic was arrested in Bosnia and Herzegovina on Tuesday, 13 December 2011, and the Court of Bosnia and Herzegovina ordered him into custody until his transfer to The Hague Tribunal the next day.

The date of his initial appearance before the judges of The Hague Tribunal will be announced at a later stage.

Radovan Karadzic, former President of the Republika Srpska (RS) is on trial before The Hague Tribunal for genocide, crimes against humanity and violations of the laws and customs of war between 1992 and 1995.

The indictment further alleges that Karadzic was a member of the joint criminal enterprise, which included members of the crisis staff and authorities in the municipalities, in order to persecute the non-Serb population from areas which the Serbs claimed as theirs.D.Dz.
