A motion that the Hague Prosecution filed with the Trial Chamber of The Hague Tribunal says that the Prosecution’s indictment contains all the necessary material facts. It says that the motion filed by the Defence of Ratko Mladic, requesting the dismissal of certain parts of the indictment, should be rejected.
In their motion filed with The Hague Tribunal’s Trial Chamber prior to the beginning of the trial, the Defence attorneys of Mladic, former Chief of the Main Headquarters of the Republika Srpska Army, VRS, say that the indictment “does not contain the basic data about the identity of victims of the alleged crimes”.
“The Prosecution admits its obligation to give names to the victims as soon as possible. However, there are no formal conditions on how to inform this. Also, it is clear that the indictee can receive these data separate from the indictment,” The Hague Prosecution’s motion says.
Mladic was arrested in Serbia in May this year after having been hiding for years. He is awaiting the start of his trial for genocide, crimes against humanity and violations of the laws and customs of war in Bosnia and
Herzegovina.
The Hague Prosecution filed a request for dividing the indictment against Mladic into two parts, one of which would pertain to genocide in Srebrenica. The Defence objected to the request. The Tribunal’s Chamber has still not rendered its decision concerning the issue.
The Prosecution’s motion filed with the Trial Chamber of The Hague Tribunal says that the Prosecution has an intention to inform the Defence about “the list of victims” as of November 1 this year.
Presenting its motion, Mladic’s Defence said that it might be that not all victims of certain crimes were known, but The Hague Prosecution had an obligation to reveal the information about the victims known to it to the Defence.
