They were not able to explain at the Court when and why Bastah filed the mentioned request.

Back in 2011 Bastah filed another request for renewal of his trial on the basis of “new facts, evidence and information”. However, the Court of BiH rejected his request in December 2011.

Bastah was sentenced, under the second instance verdict pronounced in April 2011, for having participated in the murder of civilians, unlawful detention, forced disappearances and resettlement of the population.

The Law on Criminal Proceedings of BiH stipulates that, following the pronouncement of a second instance verdict, a trial may be renewed, among other things, in case it is proved that the verdict was based on a false testimony or pronounced due to a crime committed by a judge or a person, who conducted the investigative actions, or in case new facts or pieces of evidence are presented.

Bastah was originally charged along with Goran Viskovic, former member of the Republika Srpska Army, VRS, who was sentenced to 18 years in prison for crimes against humanity committed in Vlasenica.
