The Bosnian state court’s appeals chamber on Thursday convicted Andrun of war crimes, but the former deputy commander of the Gabela camp did not appear in court for the sentencing because he was having surgery in hospital, his lawyer said.
Andrun was originally convicted in 2008 of participating in the murders, torture and inhumane treatment of civilians imprisoned at the camp in the municipality of Capljina.
According to the verdict, the wartime detention facility was established at the Gabela prison near Capljina in June 1993. By the end of that year, around 1,200 Bosniak men were detained there in four storage sheds.
The Bosnian constitutional court recently overturned the 2008 verdict on Andrun verdict because the wrong criminal code was used at his trial.
The constitutional court found that Andrun’s sentence could have been lower if he was sentenced under the old Yugoslav criminal code instead of the Bosnian one, which was introduced after he committed his crimes.
The new trial that ended on Thursday only examined the length of the sentence, not the question of Andrun’s guilt.
“The court was required to examine the decision about the criminal sanction. Because the constitutional court decision did not question the matter of guilt, the court did not examined that either,” said presiding judge Azra Miletic.
Miletic noted that the maximum sentence for the crime was 15 years of prison.
The verdict cannot be appealed.
