The sentence was reduced after the Constitutional Court of Bosnia and Herzegovina had recently quashed a second instance verdict against Pincic due to the wrong application of the law. The Constitutional Court of BiH considers that his sentence could have been shorter had the Criminal Code of the former Yugoslavia been applied.

In 2009 the Court of Bosnia and Herzegovina sentenced Pincic, according to the Criminal Code of Bosnia and Herzegovina, to nine years in prison for having raped one person several times during the war. 

Pincic, former member of the Croatian Defence Council, HVO, was sentenced for having come to a house in Donje Selo village, Konjic municipality, where Serb civilians – women and children, were detained from November 1992 to March 1993 and raped one of the women several times.
