As indicated in the announcement, the Appellate Chamber declined a State Prosecution appeal against the verdict of release in the case of Zoran Marjanovic and confirmed the first instance verdict.

Under the first instance verdict pronounced by the Court of Bosnia and Herzegovina in April this year, Marjanovic was acquitted of the charges that he unlawfully arrested a Bosniak family in Marina Homora village, Rogatica municipality in June 1992.

According to the charges, the family was then taken to Borike. Unknown members of the Republika Srpska Army, VRS then took the mother and four young children to the Veljko Vlahovic school building in Rogatica and detained them there, while the father was taken to an unknown direction. He has been missing since.

The Prosecution of Bosnia and Herzegovina presented its appeal and proposed to the Court to revoke the first instance verdict.
