“It is necessary to continue working on war-crimes cases. That is the road towards achieving justice for victims and their families throughout Bosnia and Herzegovina without any differences. The issue should not be politicised. It is necessary for all competent institutions to continue with their professional work on war-crimes processing,” the announcement says.

The European Court for Human Rights determined that the Court of Bosnia and Herzegovina wrongly applied the Criminal Code of Bosnia and Herzegovina from 2003 at the trials of Maktouf and Damjanovic, because, in those concrete cases, the mentioned Code was not more favourable for perpetrators.

The European Court’s decision says that Maktouf and Damjanovic could have been sentenced to less than 5 and 11 years’ imprisonment had the Criminal Code of the Socialist Federative Republic of Yugoslavia, SFRJ, from 1976, been applied.
