Cousins Milan and Sredoje Lukic are to face trial in Sarajevo afterthe International Criminal Tribunal for the former Yugoslavia (ICTY)agreed to transfer their case to the Court of BiH.
The ICTY indictment charges Milan Lukic, as the leader of the notorious paramilitary formation Beli orlovi (White eagles) or Osvetnici (Avengers) in Visegrad, with war crimes and crimes against humanity.Sredoje Lukic, a pre-war policeman and a former member of this paramilitary formation, with crimes against humanity.
It isfurther stated in the indictment that they both took part in burning to death more than 70 Bosniaks, women, children and elderly, in a house in Pionirska street, as well as another 70 in Bikavac settlement.
They are also charged with the torture and beating of Bosniaks who were detained in Uzamnica military barracks. Milan is additionally charged with the execution of Bosniaks committed on Drina river.
MilanLukic was arrested in the summer of 2005 in Argentina, while Sredojesurrendered to Republika Srpska authorities in the same year, afteryears of hiding in Russia.
In accordance with its 11 bis rule,the ICTY decided that they could both be tried before the Court of Bosnia and Herzegovina. The indictees have the right to appeal this decision.
To date, the ICTY has forwarded nine indictees to be processed before the Court of Bosnia and Herzegovina.
