Neither the court nor the prosecution has been able to confirm whether the case will be referred to another jurisdiction, since Kusic is a Serbian citizen.

Kusic, a former commander of the Rogaticka Brigade of the Bosnian Serb Army, has been charged with deliberately organizing and participating in a joint criminal enterprise to unlawfully detain the non-Serb civilian population in detention facilities in the municipality of Rogatica. Kusic allegedly acted in collaboration with police from the public safety station of Rogatica.

According to the charges, the detained civilians were killed, beaten, abused, used for forced labour and taken to unknown locations. Many of them have been missing since their detention.

The Bosnian state prosecution previously stated that many of the detained women and girls were raped and sexually abused. The prosecution also alleges that Kusic participated in more than 150 murders in Rogatica and at the Paklenik pit.
