The Appellate Chamber upheld the Defence’s appeals, which said that the first instance verdict was “incomprehensible and contradictory, as well as that it does not contain reasons for the decisive facts,” the Court of BiH announced.

The Chamber did not consider the remaining allegations contained in the appeals.

A new trial will be held before the Appellate Chamber.

A year ago Planincic, Menzil and Vatrac, former members of the Territorial Defence in Kotor-Varos, were pronounced guilty of having participated in an attack on Serdari on September 17, 1992, when 16 Serb civilians, including women and children, were killed.

Planincic and Menzil were sentenced to 11-and-a-half years in prison each, while Vatrac was sentenced to ten-and-a-half years.

Rasim Lisancic, who was also tried in this case, was sentenced to nine-and-a-half years in prison. Following the pronouncement of the verdict, Lisancic died, so the proceeding against him was discontinued.
